Terms and conditions

1. The webshop available under www.equishop.com is kept by EQUIRRIA Sp. z o.o. with its registered seat in Katowice, aleja Korfantego 105, registered in the National Court Register kept by the District Court in Katowice, Commercial Division with number KRS 0000157387 and registered as a VAT payer with a tax identification number NIP 954-19-60-124 and REGON number 273420733, hereinafter called “Shop”.

2. The webshop conducts sales through the Internet network under www.equishop.com. Prices and information concerning products placed on the shop’s website shall not constitute an offer according to the Civil Code, only an invitation to negotiations.

3. An order in the webshop may be placed by every natural person with full legal capacity and with permanent or temporary residence in Poland as well as every legal person and organizational unit with its seat in Poland, hereinafter called “Client”. Natural and legal persons with permanent or temporary residence in the EU-member countries have the same rights.

4. Sales agreement is entered into when the shop confirms the order. Confirmation is sent by email, by fax or in writing to the address given by the Buyer. Transactions made with credit cards and wire transfer are cleared through the Dotpay Clearing Centre, SIX Payment Services (Europe) S.A, PayPro SA/DialCom24 Sp. z o. o., PayPal Inc. and PayU S.A.

5. Object of the webshop’s activity is the sales of horse-riding equipment. A detailed list of products along with unit prices is on the Shop’s website.

6. Prices on the website include VAT and are in EUR. The price binding for the Buyer and EQUIRRIA Sp. z o.o. is the price on the website during placement of the order, under condition that it has been confirmed in the order confirmation.

7. Information about Goods given on the Shop’s website, especially descriptions, technical and performance parameters and their prices, constitute an invitation to enter an agreement, according to the Article 71 of the Civil Code.

8. A limited amount of Goods is assigned for promotional sale and completion of orders is based on the first come, first served basis, until promotional stock has run out.

9. The condition necessary to complete the order is a properly filled out internet account registration form by the Buyer.

10. The order will be completed under condition that the wares are in stock or at the shop’s suppliers. In the case when some of the ordered wares are unavailable, the Client is informed about the status of the order and makes a decision about further proceedings (partial completion, extending waiting time, cancelling the whole order).

11. Client is kept up-to-date about changes in the prices of goods and services offered on the website.

12. Payment for goods from the shop is made in form of payments described in the Terms and regulations.

13. When the Client is late with payment for the ordered goods the Shop reserves the right to immediately block the Client’s rights to make further purchase in the shop.

14. Each order is accompanied by a VAT invoice. The VAT invoice is issued when all goods ordered by the Client are completed and ready to be shipped.

15. According to the act issued on 10th May 2018 about personal data security (Journal of Laws of the Republic of Poland position 1000 with later changes), we would like to inform you that personal data provided by the Client will be protected from the access of the third parties. Personal data is collected only for the needs of the EQUIRRIA Sp. z o.o. company for the record, especially in order to complete the purchase-sale agreement. We also assure that the Client has a right to inspect their data and to correct it. Commercial information will be sent by email only if you have agreed to receive them in such a form (subscription to the newsletter). Consent can be withdrawn at any time. 16. The Client can choose from the following forms of payment for the ordered goods: - bank wire transfer, - payment via PayPal, - payment in the shop. Polish customers can choose from the following forms of payment for the ordered good: - bank wire transfer, - payment via DotPay, - cash on delivery, - payment in the shop.

17. Goods are delivered to the Buyer by a delivery company. Cost of shipping of the goods can be seen after adding goods to the basket on the website. Purchased goods are delivered to the address provided by the Buyer.

18. Each product is accompanied by time of order completion. It is the time from placing the order and making a payment to the shop’s account (the later date will be valid) to sending the ordered products from the shop, only working days are taken into account. The ordered products with different time of completion are sent after completing the whole order, i.e. after the time which is the longest.

19. Date of receiving the package is understood as the time of order completion together with the estimated delivery time.

20. When the Buyer is not present at the given address, the courier leaves a notice with the date and time of the delivery attempt with the date for the second attempt of delivery.

21. In the case of an unfounded decline to accept the package the ordered products return to the shop, the Client will be charged with the delivery cost.

22. If the products have an „upon order” status, the date of accepting the order for completion depends on the product’s availability at the supplier’s. In such a case the shop reserves the right to individually set a new delivery date with the Buyer, change or cancel the order.

23. The shop delivers products in Poland and to the European Union member countries, charging for the delivery to the address set by the Buyer.

24. In accordance with the Act of 30 May 2014 regarding Consumer Rights (Dz.U. 2020, item no. 287, as amended) the customer may resign (by withdrawing from the contract) from the goods purchased from the webshop without giving a reason within 14 days from the delivery date, by providing a written statement (e.g. a letter sent by post, fax or e-mail) or by filling out a form. A model withdrawal form is included in Appendix No. 2 to the Act and is additionally available on the webshop page in the section on contract withdrawal. Use of the model form is not mandatory. To meet the withdrawal deadline, it is sufficient to send the statement before the expiration time. The webshop, without delay, but no later than 14 days from the date of receipt of the consumer's contract withdrawal statement, returns to the consumer all payments made by the consumer, including the cost of delivering the Goods. The money will be returned using the same method of payment used by the consumer at the time of purchase, or another method if the consumer expressly presents an agreement to reimburse in another way that does not expose the consumer to incur additional costs.

25. In addition, the webshop has an extended contract withdrawal period of 30 days from the date of delivery of the ordered goods. In the event of withdrawal from the contract after 14 days and before the expiration of 30 days, the store will immediately, no later than within 14 days from the date of receipt of the consumer's contract withdrawal statement, return to the consumer all payments made by the consumer, including the cost of delivery of the goods, with the proviso that the refund will be made to a Gift Card.

26. A Gift Card is an electronic voucher issued to the bearer, authorizing to make one or more purchases in the store within the amount limit set on the Gift Card. The Gift Card is valid for 3 months from its date of issue.

27. Please also note that the indicated above, in point 25, extended withdrawal period does not limit the right under the Act. The consumer shall bear the direct costs of returning the item, which is the cost of shipping the returned goods. The shop shall refund the costs incurred by the consumer in the amount of the cheapest ordinary delivery method offered by the webshop. In accordance with generally applicable law, the webshop is not obliged to cover the cost of shipment sent by cash on delivery. The webshop has the right to withhold the refunded amount due until it receives the returned goods or the consumer provides proof of their return, whichever event occurs first.

28. The right to withdrawal from the contract concluded outside the business premises or at a distance is not granted to the consumer in respect of contracts:

    1. for the provision of services for which the consumer is obliged to pay the price, if the trader has fully performed the service with the express and prior consent of the consumer, who was informed before the start of the service that after the performance of the trader, the consumer will lose the right to withdraw from the contract, and accepted it;
    2. in which the price or remuneration depends on fluctuations in the financial market, over which the trader does not control, and which may occur before the deadline for withdrawal;
    3. in which the object of provision are non-refabricated goods, produced to the consumer's specifications or to meet the consumer’s personal needs;
    4. in which the object of provision are perishable goods or goods with a short shelf life;
    5. in which the object of provision are goods delivered in sealed packaging, which opening entails that the product cannot be for health or hygiene reasons, if the packaging has been opened after delivery;
    6. in which the ordered goods after delivery, due to their nature, become inseparable from other goods;
    7. in which the object of provision are alcoholic beverages, the price of which was agreed upon at the conclusion of the contract of sale, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the trader has no control;
    8. in which the consumer expressly requested that the trader come to him for urgent repair or maintenance; if the trader provides additional services other than those requested by the consumer, or supplies goods other than spare parts necessary for repair or maintenance, the consumer has the right to withdraw from the contract with respect to additional services or goods;
    9. in which the object of provision are sound or visual recordings or computer programs delivered in sealed packaging, if the packaging was opened after delivery;
    10. for the supply of daily newspapers, periodicals or magazines, except for a subscription contract;
    11. concluded through a public auction;
    12. for the provision of services in the field of accommodation, other than for residential purposes, transportation of goods, car rental, gastronomy, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service;
    13. for the provision of digital content not delivered on a tangible medium, for which the consumer is obliged to pay the price, if the trader has started the performance with the express and prior consent of the consumer, who was informed before the start of the performance that after the performance by the trader will lose the right to withdraw from the contract, and accepted it, and the trader has provided the consumer with the confirmation referred to in Article 15, paragraph 1 and 2, or Article 21, paragraph 1 of the Act;
    14. for the provision of services for which the consumer is obliged to pay the price, where the consumer expressly requested the trader to come to the consumer for repair, and the service has already been fully performed with the express and prior consent of the consumer.

29. Prices provided on the website are valid only for the web offers.

30. The order is confirmed by an email within 2 working days.

31. All of the named products, names and trademarks are used for identification only and can be registered trademarks of their respective owners.

COMPLAINTS

Basket clause

1. All products available in the shop are under the producer’s warranty.

2. A customer is a natural person performing a legal transaction (placing a contract of sale by the use of Equishop.com store), whose activity is not directly connected to his or her business or economical operations (according to the content of 221st article of Polish Civil code).

3. A professional customer is a natural person who places a contract (especially a contract of sale by the use of the Equishop.com store), whose contract is directly connected to this person’s business activity, when the content of the contract states that this contract does not have a professional nature for the customer, resulting especially from the subject of this person’s economic activity, on the basis of proper registration of such a person in the Central Register and Information of Economic Activity.

4. The dealer is responsible for the defects of the products sold in the store on the basis of the rules quoted in the generally effective law, especially based on the regulations about warrant regulated by the act from 23rd April 1964 of the Polish Civil code.

5. The dealer is responsible by the warranty regulations in a case where a physical defect is stated before the end of two years from the date of delivery of the goods to the Buyer. In the case where the Buyer is a consumer.

7. The buyer can use our complaint form available at the link https://www.equishop.com/downloads/Complaint%20notification.pdf. The buyer should place the following:
- contact details,
- the demand – in the most precise way possible,
- number of the receipt or invoice,
- description of the noted defect – in the most precise way possible,
- the basis of the demand (guarantee or warrant).

8. Naming as many details as possible listed in point 4 will speed the complaint process and make it easier to handle.

9. In the case of using the warrant, the buyer is bound to deliver the faulty product to the dealer freight forward. The faulty products must be sent to: Sklep jeździecki Equishop, Aleja Korfantego 105, 40-161 Katowice, Poland. In case of any doubts, the buyer can contact our customer services.

10. The product the buyer is returning should be clean, which will make the complaint process easier.

11. If the buyer who is a consumer or a professional consumer had raised a warrant demand and the dealer did not make a stand within 14 days of the reception of the complaint, it is decided that such a demand was considered legitimate regardless of the rationale.

WARRANTY

1. In the case of raising a warranty in the complaint process by the Buyer, the eligibility stemming from this title should be in line with the entries quoted on the guarantee certificate (document), directly at the producer, who is a surety, which will help speed the complaint process up.

2. The Buyer has the right to place the guarantee demand through the agency of the Dealer, who will pass such a complaint to the surety.

3. A guarantee complaint can be submitted digitally to our e-mail address kontakt@equishop.com or in writing to our physical address: EQUIRRIA Sp. z o.o., al. Korfantego 105, 40-161 Katowice, Poland.

4. The Buyer has the right to the guarantee privilege regardless of the warranty privilege.

28. If the goods have been returned without providing any reason the costs of returning them is borne by the buyer.

29. Goods sale agreement is entered into in accordance with the Polish law and in Polish.

30. Goods offered in the store functioning at www.equishop.com are free from defects.

31. Clients may access these Terms and conditions any time through the link on the main website of the www.equishop.com service and download them and print them out. Recording, securing, making available and confirming vital stipulations of the Agreement of the sale of Goods to the Client takes place by sending confirmation, order specification and VAT invoice to the given Client.

32. We would like to inform you that each client from the European Union country of the on-line Equishop store may reserve the right to decide any possible conflicts considering purchases via ODR platform, accessible here: https://ec.europa.eu/consumers/odr/main/?event=main.home.show.
